Terms of Use

These terms are an agreement between you and Apex Technology Enterprises Ltd (“we”, “us”), a company registered in England and Wales with company number 15019510, registered office 167-169 Great Portland Street, Fifth Floor, London W1W 5PF, United Kingdom. They cover the VitaMood app and this website. By creating an account or using the app you agree to them. Our Privacy Policy explains how we handle your data.
What VitaMood is
VitaMood is a voice journal. You record a short check-in, your phone transcribes it, and the app gives you a summary, a mood score, an energy level and tags. Health insights compare your check-ins with health data you allow the app to read.
Wellness, not medical care
- VitaMood is a wellness app. It is not therapy, it is not a medical device, and it does not diagnose, treat, cure or prevent any condition.
- Summaries, scores, tags and insights are generated automatically and can be wrong. Insights show what happened alongside your mood. They do not show that one thing caused another.
- Do not use VitaMood instead of a doctor, therapist or other professional, and do not delay getting help because of anything the app shows.
- VitaMood is not for emergencies. If you are in crisis or think you may harm yourself or someone else, contact your local emergency number now.
Who can use it
You must be 18 or over. You need an account, and you are responsible for keeping your sign-in details safe and for what happens under your account. Tell us at support@vitamood.app if you think someone else has used it.
Subscriptions and the free trial
- VitaMood Pro is an auto-renewing subscription, monthly or annual, sold through the App Store or Google Play. The price and billing period are shown in the app and in the store before you buy.
- New subscribers get a 7-day free trial. When the trial ends you are charged for the plan you chose unless you cancel before then. The store shows the trial length and the price before you start.
- The subscription renews automatically for the same period at the price then in effect until you cancel. Payment is taken by Apple or Google on your store account.
- Cancel in your App Store or Google Play subscription settings at least 24 hours before the trial or the current period ends. You keep access until the end of the period you have paid for.
- Deleting the app or your account does not cancel a subscription.
- Refunds are handled by Apple or Google under their own refund policies. We cannot issue refunds for store purchases.
- If we change the price, the store tells you before the new price applies, and you can cancel.
Your content
Your check-ins belong to you. You give us permission to process the transcript text and the other data described in the Privacy Policy only to provide the service to you. We do not use your content for advertising or to train AI models.
Fair use
You agree not to:
- use VitaMood for anything unlawful
- try to get around the daily limit, App Check or other protections, or access our servers other than through the app
- copy, reverse engineer or resell the app, except where the law allows it
- send content that is meant to disrupt the service or attack others
The app allows 3 summaries per day (UTC). We may suspend or close an account that breaks these terms, and we tell you why unless the law prevents it.
Third-party services
The app relies on Apple, Google (Firebase, Gemini, Play Integrity and Google Play), RevenueCat, Hugging Face and Cloudflare, as described in the Privacy Policy. Your use of the App Store, Google Play and your phone’s Health apps is also governed by their own terms.
Our intellectual property
We own the app, its design and its content, apart from open-source components, which are listed with their licences in the app. We give you a personal, non-transferable, revocable licence to use the app on devices you own or control, under these terms and the store’s usage rules.
Changes to the service and these terms
We may change or stop features. If we change these terms in a way that matters, we tell you in the app or by email before the change takes effect. If you do not agree, you can stop using VitaMood and cancel your subscription.
Ending the agreement
You can stop at any time by cancelling your subscription and asking us to delete your account (see Delete your account). We may end these terms if you break them or if we stop offering VitaMood. If we stop offering VitaMood, we tell you in advance.
Liability
- Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
- If you are a consumer, you have legal rights in relation to digital content that is faulty or not as described. These terms do not affect those rights.
- The app is provided for personal, non-commercial use. We are not liable for business losses such as lost profit or lost data.
- We are not liable for losses that were not reasonably foreseeable, or for decisions you make based on the app’s summaries or insights.
- Otherwise, our total liability to you is limited to the amount you paid for VitaMood in the 12 months before the claim.
App Store terms
If you downloaded VitaMood from Apple’s App Store:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Your licence is limited to using the app on Apple-branded products you own or control, as allowed by the App Store usage rules.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you can notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
- If a third party claims the app or your use of it infringes their intellectual property, we, not Apple, are responsible for dealing with that claim.
- You confirm that you are not in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland, Northern Ireland, the European Union or another country whose consumer law protects you, you also keep the protection of that law and can bring a claim in your local courts.
